These Terms & Conditions apply to all enquiries, bookings, and participation in activities offered by Lekker Hike Cape Town (“Lekker Hike”, “we”, “us”, “our”).

By booking or participating in a hike with Lekker Hike, you confirm that you have read, understood, and agree to these Terms & Conditions, together with our Cancellation Policy and Privacy Policy.

1. Bookings & Confirmation

• A booking is only confirmed once full payment or an agreed deposit has been received
• All bookings are subject to availability
• Lekker Hike reserves the right to decline, cancel, or amend bookings at its discretion

2. Scope of Activities

Lekker Hike offers:

• Day hikes & Community Hikes
• Bespoke / Customized hikes
• Multi-day and overnight hikes

Each experience varies in difficulty, duration, terrain, and exposure. Guests are responsible for selecting a hike appropriate to their fitness, experience, and comfort level.

3. Participation & Assumption of Risk

Hiking and outdoor activities involve inherent risks, including but not limited to:

• Uneven or slippery terrain
• Slips, falls, and physical exertion
• Exposure to weather and environmental conditions
• Rockfalls, wildlife, or other natural hazards

By participating, you acknowledge that you do so voluntarily and at your own risk.

While Lekker Hike and its guides take reasonable precautions, we cannot be held liable for injury, illness, loss, damage, or delays that may occur during or in connection with the hike.

4. Fitness, Health & Guest Responsibility

• Guests are responsible for ensuring they are physically fit for the selected hike
• Any injuries, medical conditions, or physical limitations must be disclosed prior to the hike
• Participation may not be suitable for individuals with certain health conditions, limited mobility, or during pregnancy

Lekker Hike reserves the right to advise against participation or refuse participation where safety concerns arise.

5. Guide Decisions, Safety & Emergency Management

For safety and group wellbeing, the guide may:

• Adjust routes, timing, pace, or itinerary
• Modify or shorten the hike
• Advise against participation on the day

These decisions are made with care, experience, and the best interests of the group in mind.

In the event of an emergency, the guide may take reasonable action, including contacting emergency services or arranging evacuation where necessary. Lekker Hike is not liable for any medical, rescue, or evacuation costs incurred.

Guests agree to respect the guide’s judgement and instructions at all times.

6. Arrival & Punctuality

• Guests must arrive at least 15 minutes before the scheduled start time
• Late arrivals (more than 15 minutes after the scheduled start) may not be permitted to join
• No refunds, credits, or reschedules are offered for late arrivals or missed hikes

7. Cancellation, Refunds & Rescheduling

All cancellations, refunds, credits, and rescheduling are governed by our Cancellation Policy, which forms part of these Terms & Conditions.

Guests are encouraged to review the Cancellation Policy carefully before booking.

8. Weather & Environmental Conditions

• Hikes continue in light rain, wind, or overcast conditions
• Weather-related discomfort does not constitute unsafe conditions
• If conditions are deemed unsafe (e.g. strong winds, storms, fires, trail closures), Lekker Hike may cancel, modify, or reschedule the hike

Safety-related decisions are made at Lekker Hike’s discretion.

9. Force Majeure

Lekker Hike shall not be held liable for cancellations, delays, changes, or interruptions caused by events beyond our reasonable control, including but not limited to extreme weather, fires, natural disasters, trail closures, government restrictions, or other unforeseen circumstances.

10. Children & Minors

• Minimum age: 12 years
• Minors under 18 must be accompanied by a responsible adult
• Participation of children under 12 must be discussed in advance and is subject to guide discretion

The accompanying adult is responsible for the minor’s safety, behaviour, and compliance with instructions.

11. Equipment & Personal Belongings

• Guests are responsible for bringing appropriate footwear, clothing, water, and sun protection
• Additional equipment may be required for certain hikes
• Lekker Hike is not responsible for loss, theft, or damage to personal belongings

12. Transport (Optional)

Lekker Hike may, from time to time, provide optional transport services to and from hike meeting points.

• Transport services must be arranged in advance
• Seats are limited and subject to availability
• Transport fees are non-refundable once confirmed

When transport is provided directly by Lekker Hike, reasonable care is taken to ensure a safe and reliable service. However, Lekker Hike is not responsible for delays, changes, or interruptions caused by traffic, weather, road conditions, or other factors beyond our control.

In some cases, Lekker Hike may make use of independent third-party transport providers. Where this occurs, the transport service is subject to the provider’s own terms and conditions, and Lekker Hike is not liable for incidents, delays, loss, injury, or damage arising from third-party transport services.

For logistical convenience, Lekker Hike may create WhatsApp groups to assist guests with sharing information, meeting points, and optional carpool coordination.

Any carpooling arrangements are made voluntarily and directly between guests. Lekker Hike does not organise, manage, supervise, vet drivers, or assume responsibility for carpooling arrangements, vehicles, or driving conduct.

Lekker Hike accepts no responsibility or liability for any incidents, delays, loss, damage, or injury arising from informal carpooling or private transport arrangements.

13. Photography & Media

Photos and videos may be taken during hikes and shared with guests or used for promotional purposes.

Guests who prefer not to appear in photos or videos must inform the guide before the hike.

14. Insurance

Guests are responsible for arranging their own insurance, including:

• Medical insurance
• Travel insurance
• Cancellation insurance (especially for bespoke or multi-day hikes)

Lekker Hike is not liable for medical, evacuation, rescue, or related costs.

15. Waivers & Indemnities

Certain hikes or experiences may require guests to sign an indemnity or waiver form prior to participation.

Failure to complete required documentation may result in refusal of participation without refund.

16. Limitation of Liability

To the fullest extent permitted by law, Lekker Hike shall not be liable for any injury, loss, damage, expense, or delay suffered by a guest arising from participation in a hike or related services.

This includes, but is not limited to, incidents resulting from environmental conditions, guest actions, or third-party services.

17. Third-Party Booking Platforms

Bookings made via third-party platforms are subject to the platform’s own terms, conditions, and cancellation policies.

Lekker Hike cannot override or amend third-party platform rules.

18. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Any disputes shall be subject to the jurisdiction of the courts of Cape Town.

19. Agreement

By booking or participating in a hike with Lekker Hike, you confirm that you have read, understood, and agree to these Terms & Conditions, the Cancellation Policy, and the Privacy Policy.
